TDS on freelancer and professional payments in India: a 2026 small-business checklist

When should a small business check TDS on a freelancer payment?
A business paying a freelancer may need to deduct tax at source, but the answer depends on what the person actually does, the contract, payee status, payer type, amount and timing. Do not label every independent contractor payment as professional fees: work can fall under different withholding categories. For amounts credited or paid from 1 April 2026, the Income-tax Department says the Income-tax Act, 2025 applies; earlier events remain under the 1961 Act. Verify the current table item, threshold and rate before booking or paying.
Classify the service from the real work and contract
Read the scope, deliverables and work pattern. A design, legal, accounting, technical or consulting engagement may need a different analysis from a contract for ongoing execution, commission or another service. The invoice heading alone does not decide the legal category. Ask a tax professional to review unusual, bundled or cross-border work.
Check who is paying and who receives the money
TDS rules can depend on whether the payer is a company, firm, proprietor, individual or other entity and whether a threshold or exception applies. Confirm the freelancer's legal name, PAN or other required tax identifiers, residential status, business details and bank account using a secure process. A personal payment by an individual may not follow the same rule as a business expense.
Apply the law based on the earlier credit or payment event
The Income Tax Department's transition FAQ says the governing Act depends on whichever occurs first: credit to the payee or payment. An event on or before 31 March 2026 is handled under the Income-tax Act, 1961; an event on or after 1 April 2026 is handled under the Income-tax Act, 2025. For a payment credited before April but paid later, do not switch the original deduction to the new Act.

Calculate and communicate the deduction before payment
Verify the table item, threshold and rate for the event date
For payments from April 2026, the official FAQ directs deductors to the relevant table item under section 393 of the 2025 Act; old section numbers can cause reporting errors. The Department says the new Act consolidated the presentation and retained rates and monetary thresholds, but you still need the correct category and current rules. Use the current official law, e-filing guidance or a tax professional rather than copying a prior-year rate table.
Decide which amount and timing the rule applies to
Check whether the relevant provision applies at credit, payment or another event and whether the threshold is per payment, annual total or another measure. Review advances, reimbursements, bundled services, GST shown separately and contract amendments under the applicable current rule. Keep the calculation with the invoice and approval so the net payment can be explained.
Tell the freelancer what will be withheld and why
Show the gross fee, any GST or approved expense treatment, TDS amount and net payment in the remittance advice. Answer the freelancer's request for a certificate or credit trace with the applicable official process. Do not promise a tax refund or tell the payee how much income tax they personally owe; withholding credit and final tax liability are separate.
Deposit, report and reconcile deducted tax
Track the deposit deadline and pay through the official route
Once tax is deducted, record the deduction date, amount, challan, due date and payment confirmation. Deposit within the current statutory timeline using the official tax portal or authorised bank route. Missing or late deposits can create interest, recovery, penalty or expense-disallowance consequences; the date and governing Act matter.
File the correct statement and use the new section reference
Match the deductee identifiers, payment category, tax deducted and challan details in the period's statement. The Department says systems moved to new section references from April 2026 and requires deductors to update ERP and payroll processes. Use the correct old or new return format for the transaction period and check for validation errors before submission.
Reconcile the vendor ledger and certificate
Compare the business expense, freelancer invoice, withholding payable, challan, quarterly statement and certificate or tax-credit record. Follow up on a mismatch quickly and file a correction statement through the applicable process. Preserve the contract, invoice, classification note, calculation, payment proof and correspondence in the vendor folder.

Does every freelancer invoice require TDS?
No single answer covers every payment. The type of work, payer, payee, amount, threshold and date determine whether withholding applies. Classify the actual service and check the current statutory table before paying.
What changed for TDS from April 2026?
The Income-tax Act, 2025 applies to the relevant credit or payment events from 1 April 2026. The Income Tax Department says section 393 consolidates TDS provisions into a table and deductors must update the section references in their systems. Events before that date remain governed by the old Act.
Which section number should I use for a payment after 1 April 2026?
Use the relevant item in section 393's current table for the payment category. Do not automatically copy section 194C, 194J or another old number into new-period reporting; confirm the table item against the official portal and current facts.
Should I deduct TDS from GST shown on a freelancer invoice?
The treatment depends on the applicable withholding provision, invoice structure and current tax guidance. Do not apply a blanket rule from an old template; ask your accountant to document the treatment for the specific payment.
