Know what a trademark can protect
A trademark can distinguish a business's goods or services through a word, logo or other registrable sign. It protects the mark for the goods or services covered by the registration, not every part of a business idea.
Decide whether the brand name, logo or both matter
A word mark can protect the words as filed; a device mark covers a particular visual presentation. A business may eventually consider separate applications, but each mark and class has its own fee and scope.
Choose the correct owner before you file
The applicant should be the person or entity that actually owns the brand. If a woman founder creates a mark for a company, partnership or co-owned business, decide and document ownership before filing instead of selecting a convenient name that may cause a later dispute.
A woman's gender alone does not create a fee discount
IP India's lower electronic fee category is for an individual, startup or small enterprise. It is not a separate women-founder concession. Confirm the evidence needed for the selected applicant category and use only a category that applies to the actual proprietor.

Search similar marks and choose the class
A search can reveal obvious conflicts, but it cannot guarantee that an application will be accepted. Similarity, distinctiveness and the goods or services are assessed in the examination process.
Search words, spellings and logos
Look for identical and similar marks, including alternate spellings and marks used for related goods or services. Keep a dated copy of the search and ask an IP professional about a close match before spending on packaging or a large advertising campaign.
Select the Nice class that matches the actual offer
IP India groups goods in classes 1–34 and services in classes 35–45. Describe the product or service precisely; a broad but incorrect class can leave the brand exposed in the business's real market.
Avoid a mark that is generic or misleading
IP India's guidance lists lack of distinctiveness, generic or descriptive wording, deceptive marks and confusing similarity among reasons a mark may be refused. A search and professional review are useful when the proposed name is close to an existing brand.
Budget the fee and submit Form TM-A
Check the electronic fee per mark and per class
As checked on 26 September 2026, IP India lists an e-filing application fee of ₹4,500 where the applicant is an individual, startup or small enterprise, and ₹9,000 in other cases, for each mark and each class. Recheck the live fee schedule before payment because notified rates can change.
Prepare the exact application information
The filing process asks for the applicant, mark representation, goods or services description and supporting documents. If you claim that the mark has already been used, gather evidence and any required user affidavit; otherwise check the proposed-to-be-used filing route.
File through IP India's e-filing service
Use Form TM-A and the official e-filing portal, save the acknowledgement and application number, and track the status through the Trade Marks Registry. Avoid unofficial agents who guarantee approval or a fixed registration date.
Track examination, publication and renewal
An application is not the same as a registered trademark. Keep watching for examination correspondence and deadlines throughout the process.
Reply to an examination objection on time
The Registry may issue an examination report or schedule a hearing. Read the objection, calendar the response date and obtain professional help when the issue affects ownership, similarity or the legal description of the goods and services.
Allow time for publication and possible opposition
An accepted mark is published in the Trade Marks Journal, where third parties can oppose it within the applicable period. IP India's step-by-step page describes a four-month opposition window; check the current rule and status on the live Registry portal.
Protect the registration after it is granted
IP India says a registered mark is valid for ten years from the application date and can be renewed for further ten-year periods. Keep ownership, address, use and renewal records current.
Questions about registering a business trademark
Does registering a company name automatically register its brand?
No. Company or business-name registration and a trademark application are separate processes. Search and apply through the Trade Marks Registry for the mark and goods or services you need.
Can an individual woman apply before forming a company?
IP India lists individuals among people who may apply if they claim to be the proprietor. Choose the real owner and applicant category carefully, and review how the mark will be transferred if ownership later moves to a company.
Does payment guarantee registration?
No. The Registry examines the application and third parties may oppose a published mark. The fee pays for filing; it does not guarantee acceptance, registration or freedom from every dispute.
Is the lower fee only for women-owned enterprises?
No. The listed lower category is based on the applicant being an individual, startup or small enterprise, not on the founder's gender alone.
