Property, inheritance and stridhan

A woman's own property does not become her husband's or in-laws' property because of marriage. Inheritance rules depend on the applicable succession law, religion, family form, title, will and facts, so precise advice matters.

What this situation can include

  • Control can include keeping jewellery or wedding gifts intended for the woman, forcing signatures, removing her name from records, hiding a will, excluding a daughter from partition, taking pension or rent, or preventing access to bank and identity documents.
  • Stridhan is commonly used for property belonging to a woman, including certain gifts received at stages around marriage. Whether a particular item is hers depends on the source, intention, proof and applicable law—not simply who physically holds it.
  • Under the Hindu Succession Act, as amended, a daughter of a coparcener becomes a coparcener by birth in her own right in the same manner as a son, with corresponding rights and liabilities in the statutory system.

What this may mean

First identify the asset, title or account holder, how it was acquired, who paid, whether there is a nomination or will, which succession law applies, who possesses it and whether any transfer was signed under pressure.

Domestic Violence Act monetary or residence relief and return of property may be relevant to economic abuse, while final ownership, partition or inheritance can need separate proceedings.

Nominations, joint accounts and physical possession do not always settle beneficial ownership or succession. Obtain documents and advice before transferring, relinquishing or selling.

Possible next steps

  1. Create an asset and document register

List jewellery, land, home, accounts, insurance, pension, business interests and movable property with title, source, date, current holder and supporting record.

  2. Protect originals and challenge pressure

Keep certified or secure copies of deeds, mutation, tax, bank, will, gift and marriage records. Do not sign a relinquishment or power of attorney without independent advice.

  3. Ask the right legal question

Legal aid or a lawyer should identify the applicable succession law, limitation, forum and whether urgent injunction, domestic-violence relief, partition, recovery or criminal reporting fits.

What may happen after seeking help or reporting

  • A civil or succession authority may examine title, family relationship, will, statutory shares, possession and transfers. Interim restraint may be sought where disposal is feared.
  • A domestic-violence court may consider economic abuse and specified relief without finally deciding every title dispute.
  • Police may assess a specific alleged offence where dishonest taking, coercion or forged documents are reported; not every ownership disagreement becomes a criminal case.

Important limits and cautions

  • The Hindu Succession Act does not govern every Indian succession. Personal law, secular succession law, tribal or customary rules and state land laws can change the answer.
  • Marriage, nomination, contribution, possession and title are different facts; no single one answers every asset question.
  • Family settlements and relinquishment deeds can permanently affect rights. Read, translate and independently advise before signing.

Words a supporter can use

Helping a woman organise a property question

“Let us list each asset, whose name is on it, who gave or paid for it, who holds it now and what papers exist. Do not sign or hand over originals today. We can ask which succession or property law applies and whether urgent protection is needed.”

What institutions must do

Distinguish title disputes from specific offences

  • Receive clear allegations of coercion, forgery or dishonest retention while directing civil and legal-aid questions to the correct forum.

Do not erase daughters or widows from records

  • Share documents, avoid coerced signatures and respect each woman's lawful ownership and succession claim.
