समझें कि marriage permanent consent नहीं बनाती, current Indian criminal law क्या कहता है और safety या advice कैसे लें।

Marriage permanent consent नहीं
Consent voluntary, informed और act-specific होनी चाहिए। Spouse no, pause, mind change या अलग intimacy चाह सकती है।
Relationship boundary नहीं मिटाता
Married होना, साथ रहना, पहले sex या financial dependence body पर ownership नहीं देता।
Pressure unsafe बना सकता है
Threat, humiliation, confinement, money रोकना, reproductive coercion, intoxication या fear free agreement को undermine कर सकते हैं।
Sexual violence एक ही label नहीं
Forced penetration, unwanted acts, injury, threats, reproductive coercion या sexual abuse हो सकता है। अपने शब्दों में घटना लिखें।
Survivor pace चुनती है
Information, medical care, safety plan, counselling, domestic-violence remedy या police route अलग क्रम में हो सकते हैं।
वर्तमान भारतीय कानून
Legal position specific और बदलने योग्य है। यह case assessment नहीं; qualified lawyer या legal-aid service लें।
BNS section 63 में marital exception है
Current BNS text उस act को exception देता है जिसमें पुरुष अपनी पत्नी के साथ हो और पत्नी 18 से कम न हो। यह forced sex को acceptable नहीं बनाता; criminal rape offence की statutory सीमा बताता है।
Separation में section 67 अलग है
BNS अलग रह रही पत्नी के साथ बिना consent sexual intercourse को अलग अपराध बताता है। Facts के लिए legal advice चाहिए।
Domestic-violence law sexual abuse मानता है
PWDVA civil protection और अन्य remedies देता है, जिनमें sexual abuse शामिल है। यह criminal rape prosecution जैसा नहीं।
Constitutional rights महत्वपूर्ण हैं
Dignity, bodily integrity, privacy और equality response को guide करते हैं; principle अकेले outcome तय नहीं करता।
अभी safety चाहिए तो
Immediate danger evidence collect करने से पहले आता है।
Safer place की ओर जाएं
Neighbour, trusted relative, public place, hospital या emergency service safer हो सकते हैं। Documents के लिए confrontation risk न लें।
Safer device या route लें
Phone, email, location या bank monitor हो तो ऐसे device और place से contact plan करें।
Urgent medical care लें
Injury, bleeding, pregnancy concern, intoxication, infection risk या severe distress में medical attention लें और records पूछें।
Supporter को instructions दें
Transport, call, safe bag या record में मदद लें; spouse, family या police से contact पहले discuss करें जब immediate emergency न हो।
सुरक्षित ढंग से record और advice
जो safe हो वही document करें। Perfect file न होने पर भी help मिलनी चाहिए।
Factual account लिखें
Dates, words, acts, threats, injury, contraception या pregnancy pressure, witnesses और help requests लिखें।
Records harm-doer से दूर रखें
Messages, photos, medical records और ID copies useful हैं, पर monitored device पर risk बढ़ सकता है।
Legal-aid route पूछें
क्या record होगा, notification किसे, remedies, confidentiality limits और interpreter/support person उपलब्ध है पूछें।
न समझे document sign न करें
अपनी भाषा में copy, समय और explanation मांगें; qualified adviser से अर्थ समझें।
Supporters और institutions
Safe response disclosure पर विश्वास करे और marriage को harm कम करने का कारण न बनाए।
‘क्यों रुकीं’ न पूछें
कहें: ‘मुझे दुख है। मैं आपकी बात मानती हूँ। आज क्या safer लगेगा?’
Options दें, command नहीं
Emergency care, domestic-violence support, legal aid, counselling और trusted contacts बताएं।
Confidentiality realistic रखें
जरूरी लोगों से ही share करें और legal/safeguarding limits साफ बताएं।
Responders train करें
Police, health worker और legal service consent, marital power, disability, भाषा और retaliation समझें।

क्या wife sex refuse कर सकती है?
हाँ। Marriage voluntary agreement की जरूरत नहीं मिटाती।
Physical injury न हो तो?
Visible injury न होने से forced sex acceptable नहीं। Conduct, fear, pressure और impact बताएं।
क्या तुरंत report जरूरी है?
जहाँ संभव हो safety और information पहले लें; urgent danger और medical need तुरंत address करें।
Partner trust कैसे repair करे?
Pressure रोकें, no को punish न करें, counselling लें और survivor के next steps को control करने दें।
